Steven Ray Garcia, a principal at GARCIA LEGAL, A PROFESSIONAL CORPORATION, and the founder of California Escrow Documents, has spent more than 30 years dedicated to the real estate and escrow industries. He uses his years of experience and insight to bring creative approaches to his clients’ problems. Through writing, speaking, legal scholarship, and public service, Steve has served the real estate industry in California and across America. He authored a statute that amended the Mello-Roos Community Facilities District Act and has argued more than 50 cases before the California Courts of Appeal and Supreme Court. In one landmark case, the Court quoted Steve’s brief as its rationale. That case has been followed by courts in four other states, including the New Hampshire Supreme Court, which repeated the earlier quotation from the brief Steve wrote in its opinion.
After graduating from Claremont McKenna College, Steve clerked for the Legal Division of the California Association of Realtors® while he attended UCLA School of Law. At CAR, Steve wrote an opinion letter that became the basis of a formal opinion of the California Attorney General on an issue relating to due on sale clauses. Upon his admission to the California State Bar, Steve began working in title insurance and escrow defense work, construction and business ligation, and appellate litigation, forming his current firm in 2014.
Steve has served as an expert witness in cases involving real estate brokers and land use issues. Besides that, he serves as general counsel to a number of independent escrow companies. In 2015, he founded California Escrow Documents, a subsidiary of GARCIA LEGAL, in response to the need for up-to-date general provisions, pushback letters, electronic signature amendments, and other modernized documents to better protect escrow holders through the escrow process. Steve also serves as a mediator privately, on behalf of the Los Angeles Superior Court, and as part of the Consumer Mediator Panel of the California Association of Realtors®.
He co-authored the chapter on Ownership Transfer in The Real Estate Handbook, Second Edition (1990, Dow Jones-Irwin) and has written several articles for various legal, escrow, and real estate publications. In addition, he lectures to escrow, real estate, title insurance, and legal groups and has taught Legal Aspects of Real Estate at a Southern California college. Steve was appointed to the South Pasadena Planning Commission in 2001 and was elected its Chairman in 2003, a position he held until he stepped off the Commission in October 2005. In the Fall of 2011, he was appointed to the Escrow Law Advisory Committee of the California Department of Business Oversight, serving in that position for four years. In 2012, he was appointed as a founding member of the South Pasadena Public Works Commission and was elected its chairman, a post he held until 2014. He is a founding co-chair of the Escrow and Title Subsection of the Real Property Section of the State Bar of California. Steve and his wife, Lori, also served as the Presidents of the Annapolis Parents Club of Southern California for two years of the time their youngest son was attending the United States Naval Academy.
