Danielle L. Pener is an experienced employment attorney who counsels California companies on the intricacies of employment law. Advising California employers for almost two decades, Ms. Pener focuses on providing strategic, business-savvy counsel in the following areas:
Wage-and-hour issues (including exempt v. non-exempt classification and independent contractor classification)
Leaves of absence and disability accommodation
Employee hiring, performance management, discipline, and terminations
Employee relations issues
Discrimination and harassment complaints
Ms. Pener concentrates her advice and counsel practice on a preventative approach by preparing agreements, policies, handbooks, and commission and bonus plans to ensure that companies are set up for success. Her prior in-house counsel experience at Wal-Mart Stores, Inc., Live Ops, and Twitter allows her to see the big picture and work with her clients on their compliance from a risk-assessment perspective that sets her apart from others in her field.
In her workplace investigations practice, Ms. Pener promptly and thoroughly investigates workplace harassment, discrimination and other employment-based complaints to aid employers in meeting their legal obligations to investigate complaints. A perceptive listener, she has developed an aptitude for obtaining and evaluating witness information and producing investigative findings that will withstand scrutiny. Ms. Pener specializes in complex workplace investigations and, when requested and appropriate, she assists clients in determining possible outcomes to minimize workplace disruption and find a path forward.
In all of her work, Ms. Pener leverages her experience on the complexities of California employment law, as well as local and state ordinances. Ms. Pener’s clients are involved in a variety of industries, including manufacturing, professional services, technology, retail, and hospitality.

Ms. Pener graduated with her J.D. in 2001 from University of California, Davis and with her B.A., Phi Beta Kappa, in 1998 from Washington University in St. Louis. She is admitted to the bar in California, Missouri and Kansas.
