Danielle L. Pener is an experienced employment attorney who has counseled and represented companies for her entire career. Ms. Pener focuses on bringing strategic, business-savvy advice and counsel to her clients on California employment law in the following areas:
Wage-and-hour issues (including exempt v. non-exempt classification and independent contractor classification)
Leaves of absence and disability accommodation
Employee hiring, management, discipline, and terminations
Employee relations issues
Discrimination and harassment complaints
Ms. Pener concentrates her practice on this preventative
approach. She prepares agreements, policies, handbooks, and commission and bonus plans to ensure that companies are set up for success.
In addition to her counseling practice, Ms. Pener also is a skilled workplace investigator and regularly represents companies in employment disputes including demand letters, lawsuits, audits, and agency claims. Ms. Pener conducts thorough independent workplace investigations for companies which have received a harassment, discrimination, or retaliation complaint by a former or current employee.
Ms. Pener also represents companies in employment disputes regarding gender, race, disability, age, and other protected statuses in front of state and federal administrative agencies and courts, including through trial. She regularly appears and represents clients in front of the DOL, DLSE, EDD, OLSE, EEOC, and DFEH.
In all of her work, Ms. Pener leverages her experience on the complexities of California and Federal employment law, as well as local and state ordinances. Ms. Pener’s clients are involved in a variety of industries, including manufacturing, professional services, technology, retail, and hospitality.
Ms. Pener graduated with her J.D. in 2001 from University of California, Davis and with her B.A., Phi Beta Kappa, in 1998 from Washington University in St. Louis. She is admitted to the bar in California, Missouri and Kansas.
Ms. Pener is active in the community, including serving on the Board of Camp Newman as part of the SF Jewish Federation Fed Fellows Program and in donating pro bono legal services through the Pro Bono Consulting Practice of the Jewish Federation. She also serves on the Executive Committee of her San Francisco ProVisors Group and as the Membership Chair on the Board of the Council of Business Advisors. In the past, she taught Moot Court and Legal Research and Writing as an adjunct professor at UC Hastings College of the Law and Golden Gate University School of Law, respectively, and served as the Chair of the Steering Committee of the Business Leadership Council of the Jewish Federation.
